Condizioni di vendita

Le presenti condizioni di vendita disciplinano la vendita dei prodotti commercializzati da Tenuta Montorsolo Srl. Azienda Agricola attraverso il sito: https://www.concinnate.it e il suo sottodominio https://shop.concinnate.it, che da questo punto in poi in questo documento verrà indicato come www.concinnate.it /shop.concinnate.it. Tutti i contratti di acquisto di prodotti conclusi tramite www.concinnate.it /shop.concinnate.it e secondo le procedure ivi indicate, tra il venditore e il Cliente, saranno regolati dalle presenti condizioni di vendita (in accordo alla legge italiana ed in particolare al D.Lgs. 70/2003 relativamente al commercio elettronico e al D.Lgs. 206/2005 con specifico riferimento alla normativa in materia di contratti a distanza). Eventuali modifiche o nuove condizioni di vendita verranno tempestivamente segnalate al Cliente, saranno efficaci dal momento della pubblicazione sul sito e verranno applicate alle sole vendite concluse successivamente alla pubblicazione.

Accettazione delle condizioni di vendita

L’ordine inviato dal Cliente a Tenuta Montorsolo Srl attraverso il sito deve essere completato in ogni sua parte e deve contenere gli elementi necessari per l’identificazione del Cliente e dei prodotti ordinati nonché l’indicazione del luogo di consegna, pena la sua nullità. Il contratto stipulato tra Tenuta Montorsolo Srl. e il Cliente deve intendersi concluso con l’accettazione dell’ordine su www.concinnate.it /shop.concinnate.it. www.concinnate.it /shop.concinnate.it invierà al Cliente, tramite posta elettronica, una conferma di ricevuta d’ordine.

L’accettazione si ritiene tacita, se non altrimenti comunicato con qualsiasi modalità al Cliente. Effettuando un ordine nelle modalità previste sul sito, il Cliente dichiara di aver preso visione delle indicazioni fornite durante la procedura d’acquisto e di accettare le condizioni di seguito trascritte.  Si invita pertanto il Cliente a leggere attentamente le presenti condizioni di vendita e a stamparle o salvarle su altro supporto duraturo a lui accessibile.

Modalità di acquisto

Il Cliente può acquistare solo i prodotti presenti su www.concinnate.it /shop.concinnate.it al momento dell’inoltro dell’ordine così come descritti nelle relative schede informative. Pertanto si riserva il diritto di modificare le informazioni dei prodotti senza necessità di preavviso. Le immagini presenti su www.concinnate.it /shop.concinnate.it sono fornite al Cliente per agevolare il riconoscimento dei prodotti, a causa di variazioni nel confezionamento le foto potrebbero non rispecchiare esattamente l’aspetto del prodotto consegnato. La corretta ricezione dell’ordine è confermata da www.concinnate.it /shop.concinnate.it mediante una risposta via e-mail, inviata all’indirizzo di posta elettronica comunicato dal Cliente. Tale messaggio di conferma riporterà data e ora di ricezione dell’ordine ed un “Numero Ordine”, da utilizzarsi in ogni ulteriore comunicazione con www.concinnate.it /shop.concinnate.it, così come un rimando alle presenti condizioni di vendita. Nel caso di mancata accettazione dell’ordine, www.concinnate.it /shop.concinnate.it si impegna ad una tempestiva comunicazione al Cliente. 

Prezzi e Modalità di pagamento

I prezzi dei prodotti nelle varie sezioni di www.concinnate.it /shop.concinnate.it sono comprensivi di IVA. I prezzi applicati sono quelli indicati al momento dell’ordine da parte del Cliente. I prezzi dei singoli prodotti sono suscettibili di variazione e, pertanto, i prezzi di volta in volta indicati su www.concinnate.it /shop.concinnate.it, annullano e sostituiscono quelli precedentemente indicati. Il prezzo dei prodotti acquistati, unitamente al costo della consegna a domicilio, dovrà essere pagato dal Cliente.

Il Cliente può acquistare i prodotti presenti su www.concinnate.it /shop.concinnate.it  utilizzando diverse forme di pagamento, così come indicato nella procedura d’acquisto. Eventuali costi aggiuntivi afferenti ad una determinata modalità di pagamento verranno esplicitamente evidenziati durante la procedura d’acquisto stessa.

Modalità di consegna

www.concinnate.it /shop.concinnate.it consegna i propri vini tramite corriere, alle condizioni che verranno espressamente menzionate durante la procedura d’acquisto. Ulteriori informazioni sono disponibili nell’informativa sulle consegne: Consegne/Shipping.

Diritto di recesso

Ai sensi dell’art. 52 del Codice del consumo, Il Cliente consumatore ha diritto di recedere dal contratto, nel termine di quattordici giorni, dal giorno in cui il consumatore o un terzo, diverso dal vettore e designato dal consumatore, acquisisce il possesso fisico dei beni, secondo correttezza e buona fede, previa comunicazione scritta da inoltrarsi a Tenuta Montorsolo Srl.  tramite posta elettronica all’indirizzo info@concinnate.it . Nella comunicazione il Cliente dovrà indicare il prodotto o i prodotti per i quali intende esercitare il diritto di recesso.  

Il Cliente consumatore sostiene solo il costo diretto della restituzione dei beni, purché non non concordato diversamente con Tenuta Montorsolo Srl, e nell’eventualità che i vini non possano essere normalmente restituiti a mezzo posta.

Il Cliente consumatore è responsabile unicamente della diminuzione di valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.

Garanzie

www.concinnate.it /shop.concinnate.it nei limiti di disponibilità come sopra disciplinati, garantisce che verranno consegnati prodotti eguali a quelli indicati e descritti nel sito. Per tutti i prodotti venduti vale la responsabilità del produttore. Il produttore è responsabile anche della veridicità e completezza delle indicazioni riportate sulle confezioni. 

Reclami

Ogni eventuale reclamo dovrà essere rivolto per email a info@concinnate.com.

Giurisdizione e legge applicabile

Il contratto di vendita tra il Cliente e  www.concinnate.it /shop.concinnate.it  si intende concluso in Italia e regolato dalla Legge Italiana. Per la soluzione di controversie civili e penali derivanti dalla conclusione del presente contratto di vendita a distanza, se il Cliente è un consumatore, la competenza territoriale è quella del foro di riferimento del suo comune di residenza.

Concinnate on its website: https://www.concinnate.it and its subdomain: https://shop.concinnate.it does not sell products to minors under 18 years of age. The courier will NOT deliver products to children under 18 and may request an identity document to verify their age.

Conditions of sale

These conditions of sale govern the sale of products marketed by Tenuta Montorsolo Srl. Azienda Agricola through the site: https://www.concinnate.it and its subdomain https://shop.concinnate.it, which henceforth in these Terms and Conditions will be referred to as: www.concinnate.it /shop.concinnate.it. All product purchase contracts concluded through the site and according to the procedures indicated therein, between the seller and the Customer, will be governed by these conditions of sale (in accordance with Italian law and in particular Legislative Decree 70/2003 relating to to electronic commerce and to Legislative Decree 206/2005 with specific reference to the legislation on distance contracts). Any changes or new conditions of sale will be promptly reported to the Customer, will be effective from the moment of publication on the site and will be applicable only to sales concluded after publication.

Acceptance of the conditions of sale

The order sent by the Customer to Tenuta Montorsolo Srl through the site must be completed in its entirety and must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of its nullity. The contract stipulated between Tenuta Montorsolo Srl. and the Customer must be considered concluded with the acceptance of the order on www.concinnate.it /shop.concinnate.it. www.concinnate.it /shop.concinnate.it will send the Customer, via email, a confirmation of order received.

Acceptance is considered tacit, unless otherwise communicated to the Customer by whatever means. By placing an order in the manner provided on the site, the Customer declares to have read the information provided during the purchase procedure and to accept the conditions transcribed below. The Customer is therefore invited to read these conditions of sale carefully and to print them or save them on a separate durable medium accessible to them.

Purchase methods

The Customer can only purchase the products present on www.concinnate.it /shop.concinnate.it at the time of placing the order as described in the relevant information sheets. Therefore we reserve the right to change product information without prior notice. The images on www.concinnate.it /shop.concinnate.it are provided to the Customer to facilitate product identification. Due to variations in packaging, the photos may not exactly reflect the appearance of the delivered product. Correct receipt of the order is confirmed by www.concinnate.it /shop.concinnate.it by e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the date and time of receipt of the order and an “Order Number”, to be used in any further communication with www.concinnate.it /shop.concinnate.it, as well as a reference to these conditions of sale. In the event of non-acceptance of the order, www.concinnate.it /shop.concinnate.it undertakes to promptly notify the Customer.

Prices and payment methods

The prices of the products in the various sections of www.concinnate.it /shop.concinnate.it include VAT. The prices applied are those indicated at the time of the order by the Customer. The prices of individual products are subject to change and, therefore, the prices indicated on www.concinnate.it /shop.concinnate.it from time to time will cancel and replace those previously indicated. The price of the products purchased, together with the cost of home delivery, must be paid by the Customer.

The Customer can purchase the products on www.concinnate.it /shop.concinnate.it using different forms of payment, as indicated in the purchase procedure. Any additional costs relating to a specific payment method will be explicitly highlighted during the purchase procedure.

Delivery methods

Right of withdrawal

Pursuant to art. 52 of the Consumer Code, the final consumer has the right to withdraw from the contract, within fourteen days, from the date on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the goods, correctly and good faith, upon written communication to be sent to Tenuta Montorsolo Srl. via email to info@concinnate.it. In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal.

The consumer customer only bears the direct cost of returning the goods, unless otherwise agreed with Tenuta Montorsolo Srl, and in the event that the wines cannot be returned by normal post.

The consumer customer is solely responsible for the decrease in value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

Guarantees

www.concinnate.it /shop.concinnate.it within the limits of availability as regulated above, guarantees that products equal to those indicated and described on the site will be delivered. The manufacturer’s responsibility applies to all products sold. The manufacturer is also responsible for the truthfulness and completeness of the information shown on the packaging.

Jurisdiction and applicable law

The sales contract between the Customer and  www.concinnate.it /shop.concinnate.it  is concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence.
